Magic Factory Sentencing Details Outlined

Harry Levy will serve a two year prison sentence starting in October.

Full details of the sentencing for Harry Levy were outlined in a court docket entry made Wednesday.

Levy, the owner Hank Lee's Magic Factory in Medford, won't have to report to prison for his two year sentence until Oct. 29, according to court records. A federal judge has recommended he serve his term at Fort Dix, a minimum security federal prison in New Jersey, and that he particpate in mental health care.

Levy was sentenced last week on charges of credit card fraud and issuing false statements stemming from making 134 false charges totalling over $560,000 to a customers credit card over two years, then lying to investigators who looked into them.

On Sept. 6 U.S. District Court Judge Patti Saris handed him a sentence of two years in federal prison beginning Oct. 29 and two years supervised release. His sentence also calls he pay restitution to the victim and a $6,000 fine to the government, according to Wednesday's docket entry. Saris recommended to the Board of Parole that Levy serve his term at Fort Dix prison, but it the placement is ultimately up to the board.

The victim's credit card company was able to recover about $130,000 in fraudulent charges, leaving about $430,000 to be repaid, according to court records. Levy made an initial payment of $12,207.75 to the victim on the day of his sentencing, according to the docket entry.

Leading up to sentencing, prosecutors had sought a 30 month prison term and a fine of about $60,000, while Levy's attorney argued for six months in a halfway house and six month house arrest.
