Should State Pay for Sex Changes for Inmates?

A federal judge's ruling Tuesday on a Massachusetts case is believed to be the first of its kind.

A convicted murderer will receive a state-funded sex-reassignment surgery because a federal judge has ruled it is the only way to treat her "serious medical need."

Massachusetts state prison officials must provide the surgery to Michelle Kosilek, who was convicted as Robert Kosilek for killing his wife in 1990. Kosilek was born a male but has received hormone treatments and lives in an all-male prison.

U.S. District Court Judge Mark Wolf is believed to be the first federal judge to order prison officials to provide sex-reassignment surgery for a transgender inmate, the Boston Globe reported.

Kosilek first sued the Massachusetts Department of Correction 12 years ago. Wolf ruled two years later that Kosilek was entitled to treatment for gender-identity disorder, but did not order surgery. The ruling yesterday stems from Kosilek suing again in 2005. 

Sex change operations can cost up to $20,000. Many insurance companies reject the surgery as elective. 

In his decision, Wolf stated that the surgery is the ‘‘only adequate treatment’’ for Kosilek and that ‘‘there is no less intrusive means to correct the prolonged violation of Kosilek’s Eighth Amendment right to adequate medical care,’’ the Globe reported.

Prison officials have argued that allowing Kosilek to have the surgery would make her a target for sexual assaults by other inmates.

The state should also provide a spa with stylists, facials, manicures, pedicures, the works. Why skimp out, the guy was only convicted of murder. His rights shouldn't be violated. The taxpayers and the victims of violent crimes should pay, after all their rights dont matter. Pamper the criminals because they shouldn't be subject to punishment. it's cruel and unusual to prevent him from receiving unnecessary surgury. They should fire the judge presiding in the case and give him a head examination. it's cruel and unusual for people that work and pay taxes to watch the court entertain freak show situations that are conjured up by an insane convicted murderer. the money for the surgury and the court costs could be used to help the poor. He's lucky the state provides him with 3 meals a day, a place to live, and not the death penalty. he was born a man, too bad, that's life. He is an incarcerated convict not free to do whatever he wants he lost his freedom when he was convicted of murder.

I'm sorry he feels like a woman trapped in a man's body, but I do not feel that we, the tax payers should pay for this. If he weren't in jail, he'd be paying this on his own right? In my opinion he lost all rights to not only this type of jury but my sympythy as well when he killed someone. Hell I want to be a ballerina, you don't see me asking the Boston Ballet for help!

This is why when you elect people Like deval you can expect this..granted the judge was appointed by Reagan but this is a democrat, liberal agenda if there ever was one..keep voting for these clowns..just shut your faces 4 years from now when the anointed one has ruined this country

He/she is in jail for murder...he/she was stripped of his/her rights when he/she was convicted. This is elective surgery!! Insurance companies would deny payment for this surgery for people on the outside. What gives him/her the right to ask the taxpayers to be responsible for elective surgery on a convicted murder? If Judge Wolf feels that this is the only "adequate treatment" for Kosilek, then he should go to his bank and withdraw enough money to pay for the surgery and aftercare!!!!!

With his own hands he took away his wife's rights and the judge feels he is enitled to a sex change operation at our expense? I'm sorry our tax dollars are being used to keep this MAN alive never mind give him this absurd operation! The news reported he has threatned to mutilate himself because he is trapped in a mans body. I say give him the tools he needs to follow through with his threat. I referred to him as a man but he is nothing more than a pathetic creature.
